Check you hold the most up to date Residency Documents (UK NATIONALS)

Updated: Feb 21

Residency documents in Spain are very important for UK nationals living in Spain post Brexit, as it is these documents that not only entitle us to live in Spain as a resident, but also they all us to continue to access health and social care, should we require it.

We have found that many people do not always have the right residency documents, whether it be because they never applied for a residency document, or their previous documents have expired.

We highly recommend that you clarify which document it is you currently have in your possession, to ensure you have the most up to date documentation, and that your documentation is still valid.

1) New Tarjeta de Identidad de Extranjera (TIE) (Under the withdrawal Agreement - Article 50) - VALID RESIDENCY DOCUMENT

2) Green Residency Certificates (Certificado de Registro)

If you hold one of the above documents, this is great, and you should still have residency rights in Spain.

If you have held a Green Residency Certificate for more than 10 years, the expectation from the Spanish state is that you should have updated this document at the point it was 10 years old. If you did not do so, your document is technically expired. You should consider performing the process to exchange to the TIE as soon as possible, to reduce your chances of experiencing issues when attempting the process.

It is important to note, that the current FCDO advice for Green Residency Certificate holders, is to perform the exchange to the new TIE document as soon as possible.

3) White A4 NIE Document (not a valid residency document)

This document is not a residency document, and does not provide any residency rights in Spain. If you do not hold any residency documents in Spain, and wish to obtain a residency status in Spain, you must apply for residency. You can read more about how to obtain a residency status in Spain HERE.

4) Old Style Photo Cards (no longer a valid residency document)

This document is no longer a valid residency document, and does not provide any residency rights in Spain. If you do not hold any other valid residency documents in Spain, and wish to obtain a residency status in Spain, you must apply for residency. You can read more about how to obtain a residency status in Spain HERE.

Should you not hold a valid residency document, or you are not sure if you have a valid residency document, please do let us know, and we can speak to you about the options available to UK nationals who find themselves in this situation. However, please note we are no longer taking on residency support cases as of 1st January 2022.

5) Empadron Certificates

To obtain this document, you must register with your local town hall. Pictured above, is an example of a certificado de empadrónamiento, for the municipality of Barcelona. This document is not a residency document, and does not provide any residency rights in Spain.
